2. In the present case, the petitioner seeks bail in connection with Mithanpura P.S. Case No. 343 of 2014 dated 30.11.2014, registered for the offence punishable under Section 414 read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, information was received about assembly of a gang of motorcycle thieves on an identified place and a raid was conducted. Three persons near two motorcycles were found conversing with each other, who, on seeing the Police party, tried to flee away from the spot. The three miscreants were apprehended and petitioner is one the apprehended miscreants. The petitioner and co-accused persons did not produce any papers for the motorcycles and one master key was recovered from the pocket of the petitioner.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. The petitioner was not arrested from the spot and he was arrested from his house and roped in the present case taking advantage of the criminal antecedents of the petitioner, who is having antecedent of 7 cases and out of which, he is on bail in all the cases except one. Nothing incriminating has been recovered from the person or possession of the petitioner. A similarly placed co-accused namely, Bipin Kumar has been granted bail by a learned coordinate Bench of this Court vide order dated 12.07.2024 passed in Cr. Misc. No. 38345 of 2024. Learned counsel next submits that chargesheet has been submitted in the present case. Learned counsel lastly submits that petitioner is in custody since 18.01.2024.
5. Learned A.P.P. appearing on behalf of the State opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering petitioner's period of custody and submission of chargesheet, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand

No.58034 of 2025(2) dt.27-08-2025 3/3 Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class (East), Muzaffarpur / concerned Court, in connection with Mithanpura P.S. Case No. 343 of 2014, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
