The petitioner seeks bail in a case for the offence punishable under Sections 366A and 363 of the Indian Penal Code.

The allegation against the petitioner is to have kidnapped the daughter of the informant.

It is submitted that there has been love affairs between the petitioner and the alleged victim of the occurrence and the doctor assessed the age of the girl between 16 to 17 years.

The submission of the other side is that the victim girl has made a statement before the police as well as the Magistrate under Section 164 of the Cr. P. C. in which she has stated that the petitioner has kidnapped her, made her senseless and took her to Ludhiana. The school leaving certificate of the victim girl shows that her date of birth is 10.3.2000. It also shows that the victim is minor. Considering the facts and circumstances, in my opinion, the petitioner does not deserve bail. His prayer for bail is rejected.

Let the trial of the petitioner in Sahebganj P. S. Case no. 166 of 2014 be expedited.
