JUSTICE ALOK KUMAR PANDEY ORAL JUDGMENT (Per: HONOURABLE MR. JUSTICE P. B. BAJANTHRI) Date : 29-04-2024 The present M.J.C. is filed for non compliance of order dated 05.05.2022 passed in C.W.J.C. No. 4316 of 2022. The petitioner was asked to submit representation with a period of four weeks from 05.05.2022, he had submitted representation on 18.05.2022. Such representation was required to be considered by the concerned authority within a period of three months from the date of receipt of representation i.e. on or before 17.08.2022 whereas the order has been passed on

Patna High Court MJC No.1882 of 2022 dt.29-04-2024 2/2 27.04.2024. The same has been placed on record by means of supplementary show cause on behalf of Opposite Party no. 3. There is enormous delay in complying orders of this Court. There is no application of extension of time in order dated 05.05.2022 passed in C.W.J.C. No. 4316 of 2022, in other words, Opposite Party No. 3 has committed Contempt of Court.

2. Be that as it may, having regard to the fact that respondents have complied Order of this Court belatedly. Petitioner is entitled to litigation cost and it is quantified at Rs. 5,000/-. Cost shall be paid by the Opposite Party No. 3 within a period of eight weeks from the date of receipt of this Order.

3. Accordingly, the present M.J.C. No.1882 of 2022 / contempt petition stands dropped, reserving liberty to the petitioner to assail the reasoned order dated 27.04.2024 in accordance with law.
