JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code. Petitioner is in jail custody since 06.05.2016 and the investigation against him appears to have already been completed. However, the impugned order goes to show that except the criminal antecedent as well as confessional statement of coaccused, there is nothing against the petitioner. It is a serious case of dacoity but even then petitioner was not put on Test Identification Parade by the investigating officer. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.40714 of 2016 (3) dt.24-11-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (M) P.S. Case No. 303 of 2014.
