The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504, 506 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he was assaulted with an iron rod causing injury. It is next alleged that informant suffered three injuries, out of which, one is grievous which is on the hand. It is further submitted that even presuming what has been alleged is true without admitting, then the grievous injury is not on vital part of the body. Patna High Court CR. MISC. No.58793 of 2022(4) dt.24-06-2023 2/2 19.06.2021 and the F.I.R. came to be instituted on 03.07.2021 i.e. after a delay of more than 14 days which cast aspersion on the prosecution case i.e. if informant would have injured in the manner as alleged, then definitely the hospital would have informed the police, but the same was not done in the present case.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Ashish Anand, the learned Judicial Magistrate, 1st Class, Jamui in connection with Jamui P. S. Case No.265 of 2021 dated 03.07.2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
