JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Goraul P.S. Case No. 150 of 2017 for the offences punishable under Sections 411 and 414 of the Indian Penal Code. The case of the prosecution is that while the Police was patrolling, they saw a motorcycle without number plate standing beside road and two persons who were standing near the motorcycle started fleeing away upon seeing the Police but upon chase, they were apprehended. The petitioner is said to be one of the arrested person and upon enquiry he could not produce the papers regarding the vehicle.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.49762 of 2017 (2) dt.17-10-2017 2/2 motorcycle belongs to father of the co-accused and as far as the present case is concerned, the charge sheet has already been filed, hence there is no chance of any tempering with the investigation. It is further submitted that the petitioner is in custody since 23.06.2017 and has already been penalized suitably. For the reasons stated hereinabove, I deem it fit and appropriate to enlarge the petitioner, namely Md. Shamshad on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Hajipur (Vaishali) in connection with Goraul P.S.
