JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-05-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.

On account of marital discord, Manzoori Khatoon, who was pregnant, ran away from her Sasural. In the following morning, accused persons, so named therein including these two petitioners, having variously armed came in search of Manzoori Khatoon and having been frustrated on that very score, assaulted Md. Shahid, Md. Firoz, Md. Sabir, Amina Khatoon, Md. Jiyaul, who were taken to Sadar Hospital Madhubani. Later on, only Asraf Ali, Arsad, Alfuddin, Salauddin and Nursir came in search of Manzoori and during said course, Salauddin struck over stomach of Md. Sahid which subsequently proved fatal. Both the petitioners have got no presence at subsequent stage. Furthermore, from the case diary also, no

Patna High Court Cr.Misc. No.37838 of 2014 (03) dt.20-05-2015 specific allegation has been alleged against both of them. Though, it has been suggested that one was armed with brick particle while the other lathi.

That being so, petitioners, Lalina Khatoon @ Razina Khatoon and Madina Khatoon each are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Pandaul P. S. Case no.51 of 2013, in event of their arrest/ surrender within four weeks subject to condition as enumerated under Section 438(2) of the Cr.P.C. (Aditya Kumar Trivedi, J) Vikash/- U T
