The petitioner is languishing in custody since 06.08.2014 in a case registered for the offences punishable under Sections 392/411 of the Indian Penal Code.

Informant's cash, ornaments and mobile were robbed on a pistol point.

The name of the petitioner sprang up on the confessional statement of co-accused Anil Mahto and Rajesh Kumar. Subsequently during investigation it also transpired that the petitioner was roaming around the place of occurrence just prior to the occurrence.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.3591 of 2015 (02) dt.28-01-2015 2/2 petitioner that there is no recovery from the petitioner nor the petitioner has been put on TIP.

Considering the fact that the petitioner has not been put on TIP, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bajpatti P.S. Case No. 129 of 2014.

Since the petitioner is accused in two other cases, the learned court below will cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions. (Dinesh Kumar Singh, J) DKS/- U T
