JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 This is an application for grant of anticipatory bail in connection with Bahadurpur (Fekla O.P.) P. S. Case No. 413 of 2017, disclosing offences under Sections 498A/34 of IPC. As per F.I.R. there is allegation against the petitioner,
Patna High Court CR. MISC. No.56771 of 2019(4) dt.19-11-2019 2/3 who happens to be the Nanad, father-in-law and mother-in-law of the complainant of demand of dowry and also of forcing her having illicit relationship with others also. Submission of the learned counsel for the petitioners is that all the allegations are false and concocted and does not appear to be probable as the petitioners no.1, 3 and 4 are female members and it cannot be expected from them. It has further been submitted that prayer for bail of the husband of the complainant is pending in the mediation.
Heard learned A.P.P. as well as learned counsel for the informant also, who has opposed the prayer for anticipatory bail on the ground of nature of allegations.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M., Darbhanga, in connection with Bahadurpur (Fekla O.P.) P. S. Case No. 413 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that they shall co-operate in the
Patna High Court CR. MISC. No.56771 of 2019(4) dt.19-11-2019 3/3 investigation and further they will not try to obstruct the mediation proceedings going on between the husband of the complainant and complainant.
