The petitioners seek regular bail in G.R.P. Kiul P.S. Case No. 69 of 2013, registered for the offences punishable under Section 395 of the Indian Penal Code.
First Information Report is against unknown.
Learned counsel for the petitioners submits that the petitioners are not named in the First Information Report. Name of the petitioners figured in the case in the basis of confessional statement of Mukesh Yadav. Except the confessional statement, police did not collect any tangible evidence. The petitioners were not put on Test Identification Parade. Mukesh Yadav has already been enlarged on bail.
Having considered the fact that except the
Patna High Court Cr.Misc. No.3683 of 2015 (2) dt.28-01-2015 confessional statement, there is no material against the petitioners, the petitioners, above named, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Kiul, District - Lakhisarai in connection with G.R.P.
