====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 20-08-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners are languishing in custody since 12.06.2019 in a case for the offence registered under Sections 147, 149, 323, 337, 332, 353, 224, 225, 504 and 506 of the IPC. The prosecution story, in brief, is that on 12.06.2019 in the night, under the direction of S.P., Sitamarhi, when the informant alongwith police force raided the house of absconding accused Ravi Shankar Paswan of Bairgania P.S. Case No. 110 of 2018 and apprehended the said accused, petitioners alongwith other accused persons variously armed with Lathi, Danda,
Patna High Court CR. MISC. No.51373 of 2019(2) dt.20-08-2019 2/2 Stones, Sickle etc., made murderous attack on the police force and got the said accused released from lawful custody of the poice and used criminal force to deter the public servants from discharge of their duty.
It has been submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. General and omnibus allegation has been made against the petitioners. No specific overt act has been alleged against the petitioners.
On behalf of the learned counsel for the State, it has been submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi, in connection with Bairganiya P.S. Case No. 127 of 2019.
