06-12-2016 Heard Sri Tribhuwan Narayan, learned counsel for the petitioner and Sri J.N.Thakur, learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Motihari Town P.S. Case No. 127 of 2016, G.R. No. 729 of 2016, corresponding to NDPS Case No. 9 of 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that though alongwith petitioner, one another lady was apprehended and from possession of both the ladies, recovery of about 3.5 Kg. of Opium was shown, but it has not been indicated as to what exact amount of Opium was recovered from the possession of the petitioner. It has also been argued that petitioner is having clean antecedent, whereas, learned Addl. Public

Patna High Court Cr.Misc. No.37409 of 2016 (5) dt.06-12-2016 2/2 Prosecutor, on the basis of facts disclosed in the case diary, submits that there is specific case of recovery of Opium from possession of petitioner.

In view of nature of accusation, I do not find any ground to extend the privilege of bail.

Dismissed.
