The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

According to FIR, the brother of the informant while going to coaching institute was assaulted with bricks and stones by eight named accused persons including the petitioner which resulted in his death.

Learned counsel for the petitioner submits that in fact on the same day the deceased was found along with a minor girl of the school and seeing the people he jumped from the roof of the school which resulted in injury and his death.

Patna High Court CR. MISC. No.52099 of 2019(2) dt.23-08-2019 2/2 Similarly situated co-accused Gurudyal Yadav have been allowed bail by a coordinate Bench of this court in Cr. Misc. No.41024 of 2019.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sono P.S. Case No.89 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
