JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 23-06-2015 Heard learned counsel for the petitioner and the State. The sole petitioner prays for grant of bail in connection with Akbarpur P.S. Case No. 64 of 2013 registered under section 302 IPC.

While the informant and his brother were going on road, it is alleged, the petitioner and some others fired at the informant which however did not hit him. Co-accused Siya Sharan Yadav is said to have fired at the brother of the informant which hit his head causing his death.

The petitioner is said to be in custody since 30.01.2015 having no criminal antecedent. The allegation of causing the death of the deceased is attributed to co-accused Siya Sharan Yadav.

No.16760 of 2015 (3) dt.23-06-2015 2 / 2 It is submitted that another co-accused Arun Kumar has since been released on anticipatory bail vide order dated 17.09.2013 passed in Cr. Misc. No. 25121 of 2013. In the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in Akbarpur P.S. Case No. 64 of 2013 on condition that one of the bailors of the petitioner shall be his own/close family member. He shall appear on each date fixed at the trial. In case of default in appearance on two consecutive dates the trial court shall cancel his bail bonds.
