The sole petitioner, who is in custody since 26.7.2017 in Mahua P.S. Case No. 59 of 2017 registered for the offence under Section 414 of the Indian Penal Code 1860 and section 30(A) /32 (ii) /38 (ii) /41(i) of the Bihar Prohibition And Excise Act 2016 has prayed for grant of bail primarily on the ground that petitioner was made accused on confession of a truck driver and the truck driver who made confession has already been granted bail vide Cr. Misc. No. 23725 of 2017 . Considering the nature of accusation , period of custody as well as the fact that the person on whose confession petitioner has been made accused has already been granted bail , there is no reason to further detain the petitioner.

Patna High Court Cr.Misc. No.42825 of 2017(2) dt.19-09-2017 2/2 Let the petitioner Sanjay Rai @ Sanjay Kumar Arya be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hazipur / concerned court in connection with Mahua P.S. Case No. 59 of 2017 .
