The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

426.75 liters of foreign liquor of different brands has been recovered from a pick-up van, which was parked near the house of co-accused Bipin Yadav.

It is submitted that nothing has been recovered from the conscious possession of the petitioner. Petitioner has been made accused only on suspicion that he alongwith others fled away from the place of recovery after seeing the police party. However, learned A.P.P. for the State vehemently

Patna High Court CR. MISC. No.65814 of 2021(4) dt.29-07-2022 2/2 opposed the prayer for anticipatory bail and submitted that petitioner has got two criminal antecedent of similar nature. Considering the fact that petitioner has got two criminal antecedent of similar nature, the prayer for anticipatory bail of petitioner is rejected.
