The petitioner has preferred this application for grant of regular bail in a case registered under sections 25(1-B)(a), 26 and 35 of the Arms Act and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 4.5 litres of liquor and cash to the tune of Rs. 3,59,900/- was recovered from the vehicle of the petitioner and the petitoner along with others were taken into custody. Further two country made pistols were recovered from the possession of Subodh Kumar and Kundan Kumar.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No

Patna High Court CR. MISC. No.67674 of 2021(2) dt.29-04-2022 2/2 incriminating article has been recovered from the petitioner's possession. He is in custody since 10.9.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner not having any criminal antecedent and having remained in custody for 7 months, the Court directs the petitioner to be enlarged on bail in connection with Kanti P.S. Case no. 579 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
