1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Ahiyapur Police Station Case No. 166 of 2020, dated 11.02.2020, disclosing offences under Sections 147/148/149/341/323/308/354/448/379 of the Indian Penal Code.

The prosecution case, as per the First Information Report, is that on 09.02.2020, at about 05:30 PM in the evening, when the informant was at her home, the petitioners, along with other accused persons, entered into her house. The petitioner no. 1 pulled the informant down by her hair due which she became half naked. It has further been alleged that other accused persons assaulted the informant and her family members by means of iron-rod, farsa, butt of pistol, etc. and also snatched cash, gold, mobile and other articles.

4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case due to previous enmity. A counter-case, bearing Aiyarpur Police Station Case No. 159 of 2020, has been lodged by the side of the petitioners against the informant and others. The present First Information Report has been lodged as a counter blast to the First Information Report lodged by the side of the petitioners. He next submits that the informant has lodged this case against her father, own brother and cousin brothers. He further submits that injuries sustained by the victims are simple in nature. 5. Learned counsel for the State submits that three persons have sustained injuries, however, the doctor has opined the injuries as simple in nature.

6. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the parties are closely related and injuries sustained by the victims are simple in nature, I am inclined to grant the petitioners privilege of anticipatory bail.

7. This application is, accordingly, allowed.

8. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur Police Station Case No. 166 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
