The petitioner seeks bail in a case registered for offence under sections 25(1-b)a and 26 of the Arms Act for recovery of one US made pistol and two live cartridges from his conscious possession for which he is in custody since 30.5.2017. Counsel for the petitioner denies the allegations and submits that the petitioner has falsely been implicated in this case due to other extraneous reason. He is also an accused in one other case, details of which has been mentioned in paragraph 3 of the bail petition.

In the facts of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as mentioned above, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 7th, Bhagalpur in Tatarpur (University) Police Station Case No. 90 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the

The bailor will also undertake to inform the court if there is any change in the address of the petitioner. (b) The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
