The petitioner seeks bail in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 25.07.2021, charge-sheet has been submitted in the case and has antecedent of four cases. Learned counsel for the petitioner submits that the informant alleges that on a secret information, the police force reached the place of occurrence and arrested four accused persons from whom arms and ammunition as recorded in the F.I.R. were recovered and they disclosed the name of the
Patna High Court CR. MISC. No.66217 of 2021(2) dt.20-04-2022 2/2 petitioner as one of the miscreants who fled on seeing the police. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, admittedly he was not arrested from the spot and his name was disclosed by the co-accused which has no evidentiary value. It is further submitted that because of his antecedents, the police through the co-accused got the petitioner implicated in the present case Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 25.07.2021, charge-sheet has been submitted in the case, was not arrested from the spot and his name came in the confessional statement of the co-accused, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with K. Hat (Maranga) P.S. Case No. 594 of 2021.
