2. The petitioner apprehends his arrest in connection with Ara Town P.S. Case No. 356 of 2025, registered for the offences punishable under Sections 126(2) 115(2), 109, 3(5) of the BNS 2023.
3. Based upon the prosecution report, it is alleged that a fight took place on 29.05.2025 with one Durgesh Tiwary. Thereafter on 30.05.2025, six persons, including the petitioner, came there and started assaulting Durgesh Tiwary. It is specifically alleged that co-accused Vikas Singh, Chandan Singh and Ayush Singh made open firing due to which Ashish Kumar Singh has sustained bullet injury over his left leg. There is further omnibus allegation against other accused persons,

4. Learned Advocate for the petitioner referring to the FIR contended that save and except the omnibus nature of allegation of participation in the crime, no specific overt act has been attributed. There is counter version of the present incidence leading to institution of Ara Town P.S. Case No. 357 of 2025 instituted against the informant and his associates. Considering the aforesaid facts, other co-accused persons have been allowed the privilege of anticipatory bail by a Bench of this Court in Cr. Misc. No. 56688 of 2025 vide order dated 17.11.2025. The petitioner bears fair antecedent and undertakes that he will fully cooperate in the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioner has actively participated in the crime.
6. Regard being had to the submissions made on behalf of the parties and considering the omnibus nature of allegation, coupled with the fact that the case of the petitioner based on parity and his fair antecedent, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon

Case No. 356 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
