The petitioner apprehends his arrest in G.O. Case No. 347/2015, registered for the offences punishable under Sections 47(A) and (F) of the Bihar Excise Act.

According to the prosecution, 40 litres illegal liquor and 600 kg Jawa Mahua were recovered from the vacant land of Rajo Yadav, the petitioner.

It is submitted that there is no evidence to show that the petitioner was preparing Jawa Mahua and country made liquor from Mahua. On mere suspicion the name of the petitioner has figured in the case.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court

Patna High Court Cr.Misc. No.39779 of 2016 (2) dt.19-09-2016 2/2 below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri N.K. Singh, Judicial Magistrate 1st Class, Nawada in connection with G.O. Case No. 347 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
