Petitioner apprehends his arrest in connection with Madanpur P.S.Case No. 134 of 2018 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code. Allegation against the petitioner is that he withdrew an amount of Rs.4,57,500/- in excess and petitioner is Mukhiya. Submission of learned counsel for the petitioner is that petitioner has deposited the said amount through R.T.G.S., which will appear from Annexure-2 and learned Sessions Judge has taken note of the said fact but in spite of that he has not granted anticipatory bail to the petitioner.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.47908 of 2018 (2) dt.21-08-2018 2/2 circumstances, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Madanpur P.S.Case No. 134 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
