JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-04-2015 Petitioner is languishing in custody since 06.08.2014 in a case registered for the offences punishable under Section 392 of the I.P.C and Section 3⁄4 of the Explosive Substances Act.

It is alleged that few miscreants committed robbery in the Electricity Department and took away Rs. 6,64,855/-. The First Information Report was registered against unknown. The name of the petitioner sprang up during investigation.

It is submitted by learned counsel for the petitioner that petitioner has neither been put on test identification parade nor any recovery has been made from the petitioner. Though recovery of motorcycle and Rs. 40,000/- were made from co-accused Rakesh Chaudhary and other similarly situated co-accused have been granted bail vide Cr.

Patna High Court Cr.Misc. No.13900 of 2015 (2) dt.10-04-2015 2/2 Misc. Nos. 46741/2014, 48450/2014, 47571/2014. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, Vth, Banka in connection with Sessions Trial No. 08 of 2015, arising out of Banka P.S.
