Mr. RAJENDRA NATH JHA ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 25-08-2017 I have heard learned counsel for the petitioners and the State.

The petitioners seek bail in a case registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, about 150 litres of country-made were recovered. It is urged that the petitioners no. 1 is owner of a tempo and the Petitioner no. 2 is driver. Petitioners claim that they are having clean antecedents and are in custody since 25.6.2017.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.36837 of 2017(4) dt.25-08-2017 2/2 case, the above named petitioners are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Special Case No. 3087 of 2017 arising out of Kankarbagh P.S. Case No. 457 of 2017.

If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
