JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Brahmpura P.S. Case No. 259 of 2014 registered under Section 366/34 of the I.P.C.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on 17.11.2014 married daughter of the informant is said to be kidnapped by this petitioner and one Arun Kumar Sahni, while she along with her in-laws was in the way of Doctor, but F.I.R. has not been lodged by the in-laws, rather it was lodged by father of the victim, who is neighbour of the petitioner. In fact, there is dispute in between the petitioner and informant, due to that reason

Patna High Court Cr.Misc. No.7693 of 2015 (3) dt.10-04-2015 2/2 informant managed to lodge the false case against the petitioner only to teach him lesson. Moreover, in the whole case diary, it is not clear that from where the victim was recovered. While it has come in paragraph 10 of the case diary the victim reached with her father-informant at the Police Station fromwhere he was taken for recording her statement under Section 104 Cr. P.C. It is also submitted that petitioner has no criminal antecedent and is in custody since 15.12.2014.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Muzaffarpur in connection with Brahmapura P.S. Case No. 259 of 2014.
