JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-04-2015 Both the above stated petitions arise out of Kalyanpur P.S.Case No. 170 of 2014 registered under section 302 of the Indian Penal Code and accordingly, both the above stated petitions are being disposed of by this common order.

Heard learned counsel for the petitioner as well as

Patna High Court Cr.Misc. No.1413 of 2015 (4) dt.10-04-2015 2/2 learned Additional Public Prosecutor for the State. Petitioners are not named in the first information but in course of investigation, co-accused Nitish Kumar arrested and confessed his guilt disclosing the involvement of the petitioner in the alleged crime and later on, some witnesses claimed to have seen the petitioners along with Nitish Kumar going with the deceased prior to the alleged occurrence and except the above stated circumstantial evidence, there appears to be nothing against the petitioners.

Accordingly, above named, petitioners are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Sadar, Motihari, East Champaran in connection with Kalyanpur P.S.Case No. 170 of 2014.
