JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report but the learned Sessions Judge has not mentioned in his impugned order as to how the name of petitioner came in this case though it was argued on behalf of the petitioner before Sessions Judge that except confessional statement of co-accused, there was nothing against the petitioner but learned Sessions Judge neither contradicted nor accepted the aforesaid submission. Moreover, it is submitted on behalf of the petitioner that except confessional

It is also submitted that investigation against the petitioner has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakia) P.S. Case No. 185 of 2016.
