ANJANA MISHRA ORAL ORDER 15-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 547 of 2013 registered for the offences punishable under Sections 498-A of the Indian Penal Code. Learned counsel for the petitioner submits that the husband is willing and ready to keep the lady in question with full dignity and honour and he undertakes that there shall be no recurrence of any untoward act which would amount to mental torture. He further submits that the girl in question herself wants to live in her Naihar. However, this fact has been controverted by learned counsel for the informant.

Considering the aforementioned submissions and the

Patna High Court Cr.Misc. No.38355 of 2014 (2) dt.15-04-2015 P2/2 bonafide effort made by the husband, let the petitioner in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, Kaimur in connection with Complaint Case No. 547 of 2013 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.

It is however, made clear that if there is any recurrence of act of torture on the part of the petitioner, it shall be open to the lady in question to approach this Court for appropriate orders. (Anjana Mishra, J) Saif/- U T
