This is an application for bail in connection with Maner P.S. Case No. 86 of 2017, registered for the offences punishable under Section 394 of the Indian Penal Code.
Petitioner is not named in the FIR and later on his name transpires during course of investigation on the basis of his selfconfession and stolen motorcycle has been recovered from his possession.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case on the basis of his own confession and he is in custody for eight months. Further submission is that he is made accused in six other cases but he is on bail in those cases.
Patna High Court Cr.Misc. No.47109 of 2017 (3) dt.08-11-2017 2/2 Heard learned APP also.
Having heard both sides and in view of fact that on the basis of his self confession, motorcycle has been recovered, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and try to conclude it within a period of seven months. If trial is not concluded within the said period, petitioner may renew his prayer for bail before the court below, which will be considered on the basis of materials available at that time before him. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
