====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 18-09-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner is apprehending his arrest in connection with Ekma P.S. Case No. 57 of 2018 for the offences registered under Section 414 of the Indian Penal Code and under Sections 25(1-b)a/26/35 of the Arms Act.

Informant is a police officer who in his written complaint has stated that while he was on patrolling duty checking the vehicle, three persons riding on a motorcycle tried to flee away after seeing the police but they were chased and two were apprehended but one managed to escape taking advantage of the darkness. From the two arrested persons arms were recovered from their possession and they disclosed the name of the petitioner who fled away. It has been

No.48285 of 2018(2) dt.18-09-2018 2/2 submitted that the name of the petitioner has been disclosed by apprehended accused persons becuase he is in inimical terms with petitioner. Petitioner has no criminal antecedent and was not accompanying the accused who were apprehended by the police.

Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- I/Presiding Court, Saran, Chapra in connection with Ekma P.S. Case No. 57 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
