2. The petitioner seeks bail in connection with Nowkothi P.S. Case No. 138 of 2022 registered for the offence punishable under Sections 420 and 379 of the Indian Penal Code and Section 66/66(c)/55(D) of the I.T. Act.

3. The petitioner has been found to be involved in cyber fraud. He is in jail since 03.11.2023.

4. It has been submitted by learned counsel for the petitioner that the petitioner has been found to be HIV positive.

5. Learned counsel for the petitioner has filed the main copy of the supplementary affidavit today annexing the documents in support of the fact that the petitioner is HIV

6. Considering the medical condition of the petitioner, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Begusarai/concerned Court in connection with Nowkathi P.S. Case No. 138 of 2022.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.

9. The petitioner will also mark attendance in Nagar Police Station, Begusarai on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
