The petitioner seeks his bail in Chautarwa P.S. Case No.44 of 2015 registered under Section 273 of the Indian Penal Code and Section 47 of the Excise Act.

The informant made allegation against the petitioner that when on secret information he reached at the place of occurrence the petitioner, being the driver of Bolero vehicle, was inside the vehicle and on search, the informant found spirit in the vehicle and seized the same.

It has been submitted on behalf of the petitioner that whatever has been recovered, has not been recovered from the possession of the petitioner. The petitioner has no concern with the seized spirit, neither owner nor the manufacturer of the spirit. The petitioner is in custody since 3.2.2015.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the facts aforesaid, the petitioner, named

Patna High Court Cr.Misc. No.16365 of 2015 (2) dt.10-06-2015 2/2 above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Chautarwa P.S.Case No.44 of 2015.
