The petitioner seeks his bail in khagaul P.S.Case No.150 of 2014 registered under Section 376 and other sections of the Indian Penal Code and sections 6 and 10 of the POSCO Act. The informant alleged that the accused persons including this petitioner enticed his minor son and daughter for the purpose of marriage.

It has been submitted on behalf of the petitioner that the victim was having a love affairs with the co-accused, namely, Amit Kumar and for the said reason, she has eloped with Amit Kumar in which the petitioner is said to be arrested. It is further submitted that the victim, in her statement under section 164 Cr.P.C, has made allegation against co-accused Amit Kumar but interestingly, vide Annexure-3, the victim filed the complaint case against her parents alleging that she is being forcibly being married to another person when she wants to marry with the said co-accused Amit Kumar. It is further submitted that the petitioner has no criminal antecedent and is in custody since 28.1.20125.

Considering the facts aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Ist Additional Sessions Judge, Patna in connection with Khagaul P.S.Case No.150 of 2014 (Special Case No.13 of 2015).
