2. A copy of the receipt is kept on record.

The present application has been filed for quashing of the order dated 03.04.2021 by which learned Chief Judicial Magistrate, Patna has taken cognizance against the petitioners in connection with Complaint Case No. 2620/2019 (Manish Raj Vs. Atul Punj, Chairman and others), registered under section 406/120B of the Indian Penal Code.

4. As per prosecution case, complainant was awarded a work by the Company namely M/s Punj Lloyd Delta Renewable Pvt. Ltd., relating to water purification in the Bhojpur Zone. After completion of work, total bill of the work was given as Rs. 9,26,213/- in which payment of Rs. 2,72,000/- has been made by the Company to the complainant. For payment of the rest money, he has requested many time to do so. Lastly, the petitioners refused to make payment of the remaining amount. For this, a complaint petition was lodged against the petitioners.

5. The petitioners and the complainant have settled their disputes. The petitioners have paid Rs. 7.5 Lakhs to the complainant.

6. Learned counsel for the complainant has submitted that the complainant has accepted the amount and he doesn't want to prosecute the matter any further.

7. The parties have jointly prayed that the case be quashed in view of the settlement between the parties.

8. In these circumstances, this application is allowed.

9. The order dated 03.04.2021 by which learned Chief Judicial Magistrate, Patna has taken cognizance against the petitioners in connection with Complaint Case No. 2620/2019 is
