JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-08-2018 The petitioner is apprehending her arrest in connection with Bakhri P.S. Case No. 302/2017, registered for offences punishable under Sections 409, 420, 120(B) of the Indian Penal Code.

Petitioner happens to be Mukhiya and allegation against her is that she in connivance with Panchayat Secretary and Executant Anil Kumar has withdrawn Rs. 8, 15,000/- without technical and administrative sanction for the installation of hand pumps and platform but the same has not been done. Learned counsel for the petitioner has drawn my attention towards Annexure-3, which has been issued by the B.D.O. Bakhri to submit that the money has been withdrawn by the Executant/contractor Anil Kumar and, thereafter, he handed over

Patna High Court Cr.Misc. No.48507 of 2018 (2) dt.25-08-2018 2/2 the amount to the Panchayat Secretary and out of which Rs. six lacs have been returned for non execution of the work and Rs. 2 Lacs were retained by him and petitioner has no role to play in the entire episode.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Begusarai, in connection with Bakhri P.S. Case No. 302/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
