2. The petitioner seeks bail in connection with Phulwariya P.S. Case No. 05 of 2017 dated 04.01.2017 instituted for the offence under Section 379 of the Indian Penal Code.

3. Learned counsel for the petitioner has submitted that the petitioner has not been named in the FIR. His name has transpired in the confession of coaccused/Sanjay Sahani, who has been granted bail by a Bench of this Court vide order dated 20.09.2017, passed in Cr. Misc. No. 43006 of 2017.

4. Another accused person, viz., Keyas @ Keyas Bin has been granted anticipatory bail by this Court vide order dated 04.05.2018, passed in Cr. Misc. No. 25604 of 2018.

5. Nothing has been recovered from the possession of the petitioner.

6. It has further been submitted that in the two cases, apart from the present one, which have been lodged against the petitioner, he is on bail.

7. Considering the afore-noted facts and taking into account that the petitioner is in jail since 17.05.2024, he is directed to be released on bail, on his
