JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It is a case of misuse of privilege of bail and it appears that the bail bond of petitioner was cancelled on 25-08-2011 and subsequently, he was declared absconder. However, petitioner could be remanded in this case on 04-07-2016 and since then, he is languishing in jail custody.

It would appear that the case of the petitioner was committed to the court of sessions in the year, 2005 and therefore, it goes to show that the petitioner attended the trial court continuously from 2005 to 2011 but between the aforesaid period, the trial court failed to conclude the trial of the petitioner. Considering the above-said facts and circumstances of
