Mr. Kanhaiya Kishore ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Nath Nagar (Madhusudanpur) P.S. Case no. 727 of 2017, registered under Sections 379 and 411of the Indian Penal Code and 75 of the Bihar Mines Transportation Storage Act. The accusation is that in course of patrolling duty, the informant and other Police officials intercepted a tractor bearing Reg. No. BR-10G-1109 loaded with sand in its trailer. On inquiry, the driver of the tractor disclosed his name as Munni Lal Yadav. The driver of the tractor also disclosed that he is carrying the sand from Saukhari river and he has not valid challan.

Patna High Court Cr.Misc. No.49974 of 2018(2) dt.20-09-2018 2/2 Learned counsel for the petitioner submits that petitioner is the owner of the tractor in question and he had no knowledge about the misdeeds of the driver of his tractor. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Bhagalpur in connection with Nath Nagar P.S. Case No. 727 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
