JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2017 The petitioners seek regular bail in connection with Khaira P.S. Case No. 175 of 2017, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 300 litres of liquor. It has been submitted on behalf of the petitioners that they have falsely been implicated in this case and petitioner no. is driver and petitioner no. 2 is the passenger of the vehicle from which alleged recovery was made. Further they have no criminal antecedent and have been in judicial custody since 29.06.2017. Heard learned A.P.P. also.

Having heard both sides, considering the facts and

No.43758 of 2017 (2) dt.20-09-2017 circumstances of the case and quantity of recovery, this application is disposed of with the direction to the court below to release the petitioners to his own satisfaction once charge is framed in this case or petitioners complete one more month of judicial custody, whichever is earlier.
