By order dated 12.08.2020, report was called for in the present case with regard to present stage of Sessions Trial No.120 of 2019, arising out of Chanpatiya P.S. Case No.117 of 2018 as well as the period in which the trial is likely to be concluded.

Perused the report kept at Flag 'R'. The learned Additional District & Sessions Judge-IV, Bettiah, West Champaran reported that charge has been framed by this court on 10.12.2019 and issued summon against non-official witnesses. It is also reported that after charge and issuance of summon, national lock-down started due to pandemic of COVID-19, therefore, no witness has been produced by prosecution side. Learned counsel for the petitioner submits that the petitioner is in custody since 06.06.2018.

Taking into consideration the report and the period of custody, the learned trial court is directed to conclude the trial within nine months from the date of receipt/production of a copy of this order.

If the trial is not concluded within nine months, the petitioner may renew his prayer for bail.

The prayer for bail of the petitioner is rejected for the present.
