The petitioners seek bail in connection with Sherghati (Dobhi) P. S. Case No. 105 of 2015 registered under Sections 302/34 of the Indian Penal Code and Section 3(ii)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
It is submitted by the learned counsel for the petitioners that save and except wild suspicion and hypothetical presumption, there is no other material to connect the petitioners with the alleged offences.
Patna High Court Cr.Misc. No.35149 of 2016 (2) dt.20-08-2016 2/2 On the other hand, learned counsel for the State has submitted that the petitioners are named in the FIR and the informant has suspected that his son might have been killed by the petitioners and two others.
Be that as it may, regard being had to the facts and circumstances of the case, the above-named petitioners, who are in custody since 03.06.2016 and reported to be men of clean antecedent, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghati at Gaya in Sherghati (Dobhi) P.
