ANJANA MISHRA ORAL ORDER 05-09-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends her arrest in connection with Jandaha P.S. Case No. 83/2017 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is renewing her prayer for anticipatory bail on health grounds, medical prescriptions of which has been brought on record by means of supplementary affidavit filed today. The prayer for bail was earlier rejected by this Court vide order dated 10.08.2017 passed in Cr. Misc. No. 35503 of 2017, but in view of the fact that the petitioner has been ill so she could not surrender before the Court.

It is under such circumstances and also in view of the

Patna High Court Cr.Misc. No.48854 of 2018 (2) dt.05-09-2018 2/2 changed circumstances that the husband of the deceased lady has now surrendered, the petitioner is renewing her prayer for prearrest bail. Having heard learned counsel for the petitioner and learned counsel appearing on behalf of the State and in view of the fact that the husband has now surrendered, let the petitioner in the event of her arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned A.C.J.M. XI, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 83 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
