Informant was deprived of his vehicle bearing Registration No. BR-01Q-1000 by the road robbers forcibly and during course thereof, they have also taken away different items so detailed.
It is apparent from the case diary that the aforesaid vehicle was chased and one person Kunal Kumar Singh was apprehended who made inculpatory extra judicial confessional statement. It is also apparent from para-19 of the case diary that petitioner was apprehended along with a motorcycle in a suspicious circumstance and then thereafter, as is evident from para-20 of the case diary, he was identified by the main accused, Kunal Kumar Singh to be his associate. However, during course of
Patna High Court Cr.Misc. No.17091 of 2015 (3) dt.20-05-2015 investigation, neither petitioner has been put on TIP nor any kind of incriminating article has been recovered from his possession. It is also apparent that charge-sheet has already been submitted. In the aforesaid facts and circumstances of the case, petitioner, Subodh Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Mr. S. Gandhi, Judicial Magistrate, 1st Class-Banka/successor in the office in connection with Katoriya PS Case No. 331/2014.
