2. The petitioner seeks regular bail in connection with Lalganj P.S. Case No. 362 of 2021, lodged on 10.10.2021, under Sections 304(B) & 328/34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 19.03.2024 passed in Cr. Misc. No. 78467 of 2023 with liberty granted to the petitioner that he may renew his prayer for bail nine months from the date of order.
4. Counsel further submits that the charge was framed in this case on 01.11.2022, but till date he is in custody and the evidence has not been completed. Counsel further submits that on the earlier occasion a report regarding the present stage of
Patna High Court CR. MISC. No.63640 of 2025(4) dt.28-11-2025 2/2 the trial was called for.
5. Learned APP for the State opposes the prayer for bail and submits that a report regarding present stage of the trial was called for.
6. Upon perusal of the said report, it transpires that there are four accused persons, of whom three are on bail, and the petitioner, being the husband, is in custody since 11.10.2021. Till date, only two prosecution witnesses have been examined. It further transpires to this Court that no purpose shall be served by keeping the petitioner in custody.
7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of the Additional Sessions Judge-Fifth, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 362 of 2021, subject to the following conditions as laid down under Section 480(3) of the BNSS.
