Petitioners apprehend their arrest in connection with Dhansoi P.S. Case No. 77 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 506, 448, 307, 325 of the Indian Penal Code.

The informant claims that petitioners and others assaulted him as well as his family members by means of deadly weapons as a result whereof, he as well as others sustained

However, learned counsel appearing for the petitioners submits that both parties lodged cases against each others and in the case lodged by the petitioners, the prosecution party of this case has already been granted privilege of anticipatory bail by a co-ordinate Bench of this court vide order dated 26.08.2019 passed in Cr. Misc. No. 53195 of 2019. He further submits that moreover, one co-accused, having more or less similar allegation, has also been granted privilege of anticipatory bail vide order dated 17.10.2019 passed in Cr. Misc. No. 62954 of 2019. It is further submitted that impugned order reveals that injured of this case sustained simple injury.

On the other hand, learned counsel appearing for the informant opposed the prayer submitting that photostat copy of injury reports are available on the case diary but nature of injury is not clear from perusal of aforesaid injury reports.

Patna High Court CR. MISC. No.53169 of 2019(4) dt.20-11-2019 3/3 is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in Dhansoi P.S. Case No. 77 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) shahzad/- U T
