Petitioner is not named in the first information report but in course of investigation, name of the petitioner came in this case in the confessional statement of co-accused Bimlesh Kumar @ Shashi Ranjan and after that house of the petitioner was raided and Rs 47,000/- were recovered from his house.

CCTV footage was sent to Forensic science laboratory, Patna. The report of Forensic science laboratory, Patna as well as CCTV footage have been sent by the court below. The report of Forensic science laboratory, Patna reveals that identification of culprits was not possible on the basis of CCTV footage because there was no focus on the face of the culprits as all the culprits had covered their faces.

Learned counsel for the petitioner submits that co-accused

Patna High Court Cr.Misc. No.17946 of 2015 (5) dt.28-09-2015 Ranjeet Kumar having similar allegation as well as co-accused Bimlesh Kumar @ Shashi Ranjan in whose confessional statement name of the petitioner came in this case have already been granted privilege of bail by different benches of this court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Syamal. Kumar, Judicial Magistrate, Ist Class, Danapur, Patna/ concerned court in Sigori P.S. Case no. 40/2014.

Let CD as well as report of Forensic science laboratory, Patna sent by the court below be returned to the concerned court without any delay.
