2. The petitioner is in custody since 02.08.2016 in connection with Case CI No. 258 of 2016 for the alleged offences under Sections 47(A) and 53(B) of the Bihar Excise (Amendment) Act, 2016.
3. It is submitted that the petitioner has been falsely implicated for recovery of six litres of country made 'mahua' wine, 50 litres of fermented wine and utensils for manufacturing wine and in fact no recovery has been made from the house of the petitioner.
4. Having regard to the nature of accusations and gravity of the offence alleged and recovery of large quantity of
Patna High Court Cr.Misc. No.41429 of 2016 (2) dt.04-10-2016 country made 'mahua" wine and utensils for manufacturing wine from the house of the petitioner, this Court is not inclined to grant privilege of bail to the petitioner. The bail petition stands dismissed.
