Learned counsel for both sides admit that finally divorce has been effected on mutual consent under Section 13B of the Hindu Marriage Act and both sides have agreed to withdraw their respective cases filed against each other, therefore, the entire criminal proceeding inclusive cognizance order dated 24.1.2013 in Complaint Case No.583 of 2012 pending in the court of S.D.J.M., Dalsinghsarai, Samastipur is hereby set aside. Both Petitions stand allowed.
