Case No.484 of 2014 is that the petitioner demanded a sum of Rs.50,000/- towards dowry. The case was registered and the petitioner was arrested. B.P.No.871 of 2014 filed by the petitioner was rejected by the Court of learned 1st Additional Sessions Judge, Sitamarhi on 25.08.2014. Hence, this application under Section 439 of the Code of Criminal Procedure.
Heard Sri Shankar Kumar, learned counsel for the petitioner and Sri Md. Fahimuddin, learned A.P.P. for the State. The entire allegation made against the petitioner is referable to Section 498A of the Indian Penal Code and not any serious crime. Further, the chargesheet is said to have been filed.
